Withdrawing Dangerous Driving Charge
This is a case study that involves withdrawing a Dangerous Driving charge.
Our client was facing multiple traffic charges following allegations by the police that she was driving a car and was seen doing a protracted burn out on a street. As there were people on the location of the incident, her manner of driving was deemed dangerous. The police charged her with the following offences:
- Dangerous Driving
- Careless Driving
- Improper Use of Motor Vehicle
Shaun Pascoe acted on her behalf at the Heidelberg Magistrates’ Court. It must be noted that our client has no history of traffic offences.
Shaun negotiated with the prosecution resulting in the withdrawal of the Dangerous Driving charge. This was a good outcome as this offence carries a fine of $24,000 or a prison term of 2 years, or both, as a maximum penalty; including a licence disqualification for at least 12 months.
For the remaining charges left, our client was ultimately fined and her licence suspended for 2 months.
