Our client was charged with numerous offences ranging from drugs, weapons, assault, and multiple traffic violations. These charges predated our client’s first court appearance for a drug offending and no other offences were committed ever since.
Shaun Pascoe acted on the client’s behalf at the Heidelberg Magistrates’ Court. The offences involved were:
- Dangerous Driving
- Exceed Speed Limit
- Driving When Directed to Stop By Police
- Drive Unregistered Motor Vehicle
- Fraudulently Using an Identifying Number
- Fail to Display P Plates
- Reckless Conduct Endangering Life
- Reckless Conduct Endangering Serious Injury
- Possess Drug of Dependence
- Possess Prohibited Weapon
During contest mentions, Shaun negotiated with the prosecutors and had them drop half of all the charges against our client. Serious offences were withdrawn such as Burglary, Reckless Conduct Endangering Life, and Reckless Conduct Endangering Serious Injury.
It was pointed out to the court that our client was already taking responsibility for the offences he committed prior to his first court appearance. He was determined at his rehabilitation and was already attending drug counselling sessions. Our client’s mother also testified in court that his son has disassociated himself from his negative peers and is instead focusing on obtaining good employment.
Our client was ultimately sentenced to a Community Corrections Order without conviction, with conditions that he performs unpaid community work for a specific number of hours and, more importantly, that he continues with his drug counselling and drug testing. A fine and a licence disqualification for the statutory minimum period were also imposed for the offence of Dangerous Driving.
