Culpable Driving Causing Death – Not Guilty
This is a case study on a charge of Culpable Driving Causing Death resulting in a “not guilty” verdict.
Our client was facing a charge of Culpable Driving Causing Death at the Melbourne County Court following a road accident involving an elderly person.
She was driving her car within the speed limit when the elderly person walked out into the road in front of her, was hit by the car, and got killed. The prosecution’s allegation was that our client’s car was not in proper condition – specifically, that the brakes were faulty.
Bill Doogue provided legal representation for the client. It was proven that not long prior to the incident, our client actually had her car checked by a mechanic and the brakes fixed.
Our client was found not guilty of the Culpable Driving Causing Death charge filed against her.
